Hi all, to start out I’ll kind of explain how we have to pay rent. We live in a trailer park. When we moved into our house, there was an online payment system. Then, the trailer park was bought out by another management company 5-6 months ago. They are still “working on approvals for the new online payment system”. So, for 5-6 months, there’s no option to pay online & we’ve had to pay by check or money order. At the end of the month, you pick up your statement of how much you owe & then drop off your check/money order. Our rent is $1350. We also pay water through them, they gauge how much everyone in the community uses and then divide up the cost. Our water, through them, is usually around $50-$65. So, we usually owe $1400-$1415 give or take a few dollars.
Well, this month my husband picked up our statement and it was $1465. He asked why it was so high this month. Our property manager told him it was because we had been billed for a force mow. Our lease does state if you don’t mow there’s a $50 force mow fee. However, my husband explained to her that he’s been mowing, so we shouldn’t have gotten a fee. She said “well, we had you on the list for a force mow but you did end up mowing that same day before we got to it, so we will make a one time exception and take the fee off.” They verbally agreed to take the $50, but my husband didn’t get a new statement. I know this was a mistake on his part.
Well, fast forward to last Friday, the 3rd, I dropped off our money order ($1415). Our rent isn’t considered late until the after the 5th. The leasing agent took the money order, looked at her computer, then said “you’re good to go!”. We didn’t hear anything from them until yesterday when there was an eviction notice on our door. It says we now owe $1514.38.
I called the office first thing this morning thinking they had misplaced our money order or something. Nope, the property manager called me back and said they have our money order for $1415, but that’s not the entire amount we owed so their system won’t let them submit the payment. She said we are short $99. I explained to her that my husband said he’d talked to her about the force mow situation and she had agreed to take the $50 off. I also said the statement we got says $1465, we’re short $50 (but you agreed to take that off), not $99. I’m assuming the $99 is what she’s seeing now as a late/notice fee, but didn’t get anymore clarification from her on that. After I said that, she started to get an attitude/hostile tone. She then claimed the $50 force mow fee was actually backdated from another month, & not even from last month, so she wouldn’t be taking it off. If that’s the case, that fee was never on any of our past statements and we were never notified we owed a $50 mowing fee until this statement. So were we supposed to just telepathically know we supposedly owed them $50?? I started to say that the leasing agent should’ve told me when I dropped the money order off that they couldn’t accept without the $50..or they should’ve contacted us saying they couldn’t accept our money order without the $50 fee while we could still fix the issue easily/before the eviction notice was sent out. But after I got 2 words out she cut me off and said “I will have to ask my manager and see if we can make a one time exception”. I tried to inquire again about the $99/assumed late fee they added and she cut me off again after 1 word and said “I will call you back today. Bye.”
At this point, I know we will probably have to just swallow the $50 and pay it, since it was just a verbal agreement to take $50 off and we have nothing in writing about it..so she can really claim anything she wants about the $50. However, I don’t think we should have to pay a late fee since we paid on time and I was told when I dropped payment off that I was good to go.
