Post Conviction II
2023.06.07 18:50 Justwonderinif Post Conviction II
< Friday, May 28, 2010 - Adnan could have filed for post conviction relief at any time during these past seven years, and did not have to wait ten years. Rabia lied about that.
- According to Rabia, Justin Brown has decided not to subpoena Asia, given her reaction when approached by the PI.
- Attoney Justin Brown files for Post Conviction Relief citing "Ineffective Assistance of Counsel" aka "IAC." This filing contains the first appearance of Asia's letters in the record.
- Syed asks for new trial, claiming trial counsel (Gutierrez), and appellate counsel (Warren Brown) were ineffective:
- 1) Gutierrez failed to establish a timeline disproving State's case
- 2) Gutierrez failed to investigate alibi witness (Asia)
- 3) Gutierrez failed to move for new trial based on Asia's statements
- 4) Gutierrez failed to cross-examine Debbie
- 5) Gutierrez failed to pursue a plea offer
- 6) Gutierrez failed to request a change of venue
- 7) Gutierrez failed to investigate Jay
- 8) In Adnan's appeal brief, Warren Brown failed to include the fact that Waranowitz strayed from his area of expertise, at trial.
- 9) Cumulative Ineffective Assistance of counsel.
- [Four years later, on October 18, and November 18, 2014, Rabia lied to the readers of her blog, writing that Adnan was forced to wait ten years to file for post conviction relief. The truth is the defendant has ten years from the date of conviction to file, but cannot file AFTER 10 years. In her book, Rabia wrote that she and Adnan knew all along that Adnan could file for post conviction relief the day after his appeal was denied in 2003]
- [Rabia also lies about how a 2013 google search led her to Sarah Koenig's coverage of Gutierrez' disbarment. Adnan's May 2010 filing for post conviction relief discusses Sarah Koenig's reporting. This is how Rabia would have become aware of Koenig.]
Sunday, June 27, 2010 - Adnan has been at Cumberland / Supermax for one year.
June 27, 2010 - Justin Brown files a Supplement to Adnan's May 28, 2010 Petition for Post Conviction Relief. Cites a 10th point for PCR.
- 10) Sentencing counsel, Charles Dorsey, failed to request that the motion for sentence modification be held in abeyance.
After Syed fired Gutierrez, he was represented by a public defender, Charles Dorsey. Mr. Dorsey filed a Motion for Modification of Sentence. Mr. Syed had just received a sentence of life plus 30 years. Rather than ask the Court to hold that motion in advance and raise it after, up to ten years, which is the common practice when a defendant receives a very long sentence, Mr. Dorsey didn't do that. The court ended up ruling on the Motion for Modification a couple of days after it was filed. And, of course, the motion was denied. So that's our third, ineffective assistance of counsel claim. That he should have handled that differently. - The supplement also included further points Justin Brown wanted to make about Gutierrez's failure to ask for a pleas deal.
No copies of this supplement exist on the internet. July 27, 2010 Summer 2010 - According to transcripts, Justin Brown attempts to subpoena Asia. (This could be the reason for one of the postponements.)

- Justin Brown opens. He will focus on (3) issues.
- Gutierrez's failure to investigate Asia.
- Gutierrez's failure to pursue a plea offer.
- Dorsey's failure to request that the motion for sentence modification be held in abeyance.
- Kevin Urick testifies:
- Gutierrez never approached him seeking a plea bargain. If he had been approached, there would have been a possibility of a negotiated disposition.
- Asia called him because she was afraid of being forced to testify. She had already made up her mind not to testify when she called Urick. And only called him looking for a way to get out of it.
- Shamim Rahman testifies: Posted and discussed on reddit thanks to SSR.
- Rabia Chaudry testifies: Posted and discussed on reddit thanks to SSR.

February 28, 2013 - Adnan has been in jail/prison for fourteen years.
Tuesday, May 21, 2013 June 11, 2013 August, 2013 - It has been ten months since the October 2012 Hearing for Post Conviction Relief.
- Rabia says she watched the documentary "West of Memphis," looked up reporters who covered Gutierrez's disbarment, and found Sarah Koenig. Rabia hoped that media attention could influence Welch's pending decision, ten months after the hearing.
- Rabia is lying when she talks about this 2013 google search that led her to Sarah Koenig's coverage of Gutierrez' disbarment for the Baltimore Sun. The truth is that Adnan's May 2010 filing for post conviction relief discusses Sarah Koenig and the coverage in the Baltimore Sun. This is how Rabia would have become aware of Koneig. Not via an August 2013 random google search, after watching West of Memphis.
August 12, 2013 - Rabia sends a letter to Sarah Koenig, asking her to take a look at the case. Rabia claims the police and prosecutors knew Adnan was innocent, and Gutierrez threw the case for money. Note here that leading up to Serial, Rabia was convinced that Jay did it, and would have pitched the story, with the carrot of exposing Jay.
August 29, 2013 - Rabia hastily sets up an LLC in Maryland, even though she is not licensed to practice law there.
- In anticipation of meeting with Sarah Koenig, Rabia sets up an office at Security Plaza, across the street from Woodlawn High School.
- Rabia wants Sarah to think this has always been her office, and that this is where she works. The truth is Rabia lives and works in DC.
August 30, 2013 Late September, 2013 - Adnan receives a letter from Justin Brown saying that a reporter named Sarah Koenig wanted to do an interview. Justin wrote that he didn't think Sarah would waste time on a story if she didn't believe Adnan was innocent. Adnan receives the first letter from Sarah Koenig, a few days later.
Thursday, October 10, 2013 - By now, Adnan has received an introductory letter from Sarah Koenig. She sent him a pad and pencil and stamps. Adnan writes Sarah Koenig a letter about his story and case. Discussion. - [will update link soon]
- Adnan says he wasn't much bigger than Hae.
- Adnan says that students weren't allowed to use the top parking lot. (several WHSers and Krista have said that students used the top parking lot.)
- Adnan describes the route to the Best Buy but neglects to mention the back way.
- Adnan implies that the October 31 break up was the final break up.
- Adnan says that he and Hae would joke about two women calling him on his cell phone at the same time. (Only we know that Adnan's first, ever cell phone was activated the evening of January 12, and there are no calls on the call log that support this story.)
Tuesday, October 15, 2013 - Hae Min Lee 33rd birthday
November, 2013 - Sarah Koenig meets with Chris Flohr to try to get some sense of Adnan's innocence. She tells Flohr that she won't do the story unless Adnan is innocent. Jay as the killer is context for Koenig's work on Serial.
Wednesday, November 13, 2013 Tuesday, November 19, 2013 - Adnan receives a reply letter from Sarah Koenig and puts her on his visitor list. Sarah has decided to report on the story.
Monday, November 25, 2013 - Adnan writes Sarah Koenig to thank her for her letter and let her know she is on his visitor list.
Monday, December 30, 2013 - Post Conviction Decision written by Justice Martin P. Welch.
January 2, 2014 - Andrew Davis in a single car accident, that proves fatal.
Tuesday, January 6, 2014 Mid January, 2014 - Koenig says that her first conversation with Adnan took place right after he received Welch's decision. Link to excerpt from first recorded interview
- Asia returns Sarah Koenig's call. Asia tells Sarah that when she was approached by the Defense PI, she "freaked out" and called Urick, who told her Adnan was guilty, so she dodged the attempt to produce her at the PCR.
- Bilal is notified of disciplinary action regarding his dental license, citing un-necessary treatments and overcharging on multiple occasions in 2010, 2011, 2012, and 2013.
Monday, January 27, 2014 - Defense files ALA (Applicaton for Leave to Appeal). Adnan's attorneys have to ask for permission to appeal Welch's decision, as there is no guaranteed right to appeal. Defense requests review of two issues:
- 1) Whether Gutierrez was ineffective because she didn't contact/interview Asia
- 2) Whether Gutierrez was ineffective for failing to pursue a plea deal, and telling Adnan she had.
Monday, February 17, 2014 Late February, 2014 - Sarah has met with Deirdre Enright who has agreed to work on Adnan's case.
- Two UVA law school clinics begin work on Adnan's case.

- DNA issue important to law student, Mario
February 28, 2014 - Adnan has been in jail/prison for fifteen years.
Late February/March 2014 - Justin George of the Baltimore Sun begins helping Sarah Koenig, at Rabia's urging. Rabia wanted a local reporter on the story, too.
Spring, 2014 - Approximate: Sarah emails Young Lee
- Approximate: Sarah interviews one of the prosecuting attorneys, Kathleen Murphy, for two hours
- Sarah and Dana Chivas visit Woodlawn, and surrounding areas:
- Krista shows them her scrapbook, lets them read Adnan's letters, and see her photos of Hae.
- Sarah and Dana Chivas do the drive test that Adnan asked Sarah to do. Rabia asks to go along. Sarah says no.
- Sarah shows Rabia the Enehey Report from the MPIA file. Rabia had never seen it. Sarah has redacted the name of the author of the report. She has promised the author she wouldn't reveal her name. Later, Rabia would post the report on her blog, and tell the world the name of the woman who wrote the report.
- Rabia says in her book that this report explained why the detectives focused in on Adnan. She leaves out that the report was not written until Adnan had been in jail for six months.
- Rabia dates the report as August 24, 1999, without mentioning that by then, Adnan had been arrested, indicted, and awaiting trial for months. (Later, Rabia would say that Justin Brown had a copy of the report in the police file, but never showed it to her.
- Adnan sends Sarah Koenig two "Price of Tea" charts, and asks her to hold them until the next time they speak. In October, of 2014, Koenig wrote about the subsequent conversation here.
Wednesday, May 21, 2014 May 31, 2014 June 4, 2014 July 25, 2014 Thursday, August 7, 2014 - Sarah and Julie fly to California, two weeks after the original air date for the podcast. Jay wouldn't talk to them on the phone, so they delayed the podcast, and flew to California to blind-side Jay.
Friday, August 8, 2014 - Sarah and Julie arrive at Jay's house. No one is home. They go away, then come back, for the second time, to walk across his lawn, unannounced.
- Jay said this upset his children.
- During the conversation, Jay refers to himself as a "scoundrel with scruples." Jay wisely doesn't see any upside to letting them record an interview.
Saturday, August 9, 2014 - Sarah Koenig emails Jay, apologizes for blind-siding him and causing upheaval, suggests they have a drink or coffee, and refers to the project she's working on as a documentary, not a podcast. Sarah tells Jay that the upside to doing a taped interview is that he can tell his version. Her message: "I'm going to do a story and talk about you, whether you like it or not."
August 2014 Wednesday, September 10, 2014 - Maryland Court of Special Appeals orders the State of Maryland to file a response to the defense's January 27, 2014 "ALA" (Application for Leave to Appeal). Court asks for State's response to the defense's assertion that Adnan asked for a plea, and Gutierrez failed to seek one. Court sets deadline of November 14, 2014 for State's response
September 2014 Wednesday, October 1, 2014 - Sarah writes to Rabia that the story will be presented in podcast form, over 12 episodes.

2023.06.07 18:15 anon_sir I feel lost, defeated, angry… I need help making decisions. (Car problems)
Hey y’all. I hope this doesn’t get to be too long but I’ll try to summarize my situation as quickly but thoroughly as possible.
I had a 95 Jeep Cherokee that I sold because I wanted a truck. I’m 36 but I like the old school, new stuff has too much planned obsolescence. So I bought a 83 Chevy C20. It ran ok for about 6 months and then the engine started knocking, so it’s dead. It’s fixable but new engines are 4-8k. So I bought my girlfriends old Honda civic, 2003 with 125k miles. That developed rod knock at about 145k and finally died at 150k.
So now I have no money, no cars, and no idea what to do. I don’t want to sell the truck because it has a bonded title (in 1 more year I can apply for a clean title) and a blown engine so it’s basically worthless. I can get a loan for a used car but I don’t trust that anyone takes care of their shit anymore so I’m skeptical to spend thousands of dollars on something that might break down in a month with no warranty. So that leads me to where I’m at now, looking at used Toyota Tacomas because of the reliability, but god damn, they’re expensive! I only make $25/hr so I can’t afford anything new. I have 13k in credit card debt and a personal loan with $1,600 left to pay off. Currently I’m driving my moms old Corolla but the AC needs charged, and the brakes need replaced. I know she doesn’t take care of it so I really don’t want to buy it from her, although it could help me get by until I pay off my credit card.
Unrelated maybe but my girlfriend is NOT a helpful at all. I try to be frugal, eat at home, not go out, but she always has an excuse to go out and eat out. “You can’t live your life without treating yourself, you’ll go crazy.” But I’m already going crazy because I seem to consistently make the wrong decisions and it’s going to bankrupt me. I just don’t know what to do anymore. It seems like I can buy a used car and go broke fixing it, or buy a newer car and have $600 car payments. It just makes me want to give up.

2023.06.07 17:41 Gr8tOutdoors Issues with transfer case switch/dial?
‘14 LT 4WD —- transfer case options are only 2WD, AWD and 4WD high.
I was driving this weekend and left it in AWD, then 4WD high for a total of about an hour. Towards the end of the drive i got a “service 4WD” dashboard warning and the t-case switch/dial was so hot i really couldn’t touch it. I had to leave it in AWD and turn her off until the dial cooled down, but after about an hour the warning was still on and the dial wouldnt change the setting out of AWD.
The next day everything seemed back to normal. I could change between drive settings and I even borrowed a code reader and didn’t get anything related to 4wd service.
I’m thinking something is wrong with the dial, so i ordered a new OEM replacement. BUT if that doesnt work (still overheats and trips the warning) what should i try next? New actuator?
Thanks.

2023.06.07 16:46 Ryan16R KC-135 landed at Beale AFB after circling Groom Lake/Area 51
| I live just a few miles from Beale AFB in Northern CA. Beale is primarily used for U2 and T38 trainer operations, but the other day a KC-135 flew over my house on its approach to the AFB. Like usual I fired up Flight Radar to snoop around and I found this. Not a shock or a surprise, my uncle worked there in the late 70s and in to the 80s. He died relatively young of stomach cancer a few years ago, and the only thing he ever said to me about his time there was "if you can imagine it, we have it." 2023.06.07 15:42 TechHasKilledOurMind 12V Accessory power for 4 cameras
I have a new (to me) 2013 Chevy Silverado 1500 Crew Cab pickup. I installed a Kenwood DMX1057XR w/ iDatalink Maestro RR2. The Kenwood has 4 camera inputs and I plan to put in rear, front, and side view cameras.
The question is: what is the best way for me to power these cameras? I know for just a rearview camera I could splice the power cable for the camera into the 12V accessory (red) power cable on the stereo wire harness. But, should I splice 4 cameras into that 12V accessory? Is that too many cameras for that one power source?
What is the best option for powering rear, front, and two side cameras?
Note that while the car is on, I would like the cameras to constantly have power -- so, I do not want to, for example, connect the rear camera power to the rear brake light because then it would only get power when in reverse and I would like to be able to cycle through the cameras on the head unit if I need to without having their power tied to a function.
I would REALLY appreciate help because I have searched and searched and not been successful to find examples of people sending power to 4 cameras in a DIY setup.

2023.06.07 15:11 Qwerty-2017 ACL and Motorvehicles
2018 VW Amarok purchased new June 2018 with 3 yr warranty
1 Jan 2019 all VW then move to a 5 year warranty.
So currently out of warranty but would still be if it had the 5 year warranty now offered.
Leaking oil from rear of engine, likely needs engine out to replace seal to timing chain or upper sump or big end bearing. Either way, probably $1500 ish i labour plus parts.
I’m going to approach the dealer for goodwill repair from VW.
What are my chances of ACL covering this. $70,000 4wd, always serviced and maintained on time with VW dealer and all log book servicing completed by sale dealer.
I am going to call consumer law also for their input, but wanted to try here for some advice/guidance for dealing with the dealer or VW.
Thanks in advance…

2023.06.07 15:03 royaldiamondmang 3M Hearing Loss (Military Service)
3M Hearing Loss (Military Service) refers to a legal case involving claims by military service members that they suffered hearing loss or other auditory injuries due to defective earplugs manufactured by the company 3M. The case originated from a contract between 3M and the U.S. Department of Defense (DoD) to provide earplugs for military personnel. Between 2003 and 2015, 3M supplied dual-ended Combat Arms Earplugs (CAEv2) to the military. These earplugs were designed to offer two levels of protection. In one position, they were meant to act as traditional earplugs to block out all sound. When flipped, they were intended to provide a lower level of protection that allowed soldiers to hear essential sounds like commands while still reducing harmful noise. However, allegations arose that 3M knew about design defects that rendered the earplugs ineffective, potentially leading to hearing loss or damage among service members. The lawsuit claimed that the earplugs were too short and could loosen imperceptibly, exposing soldiers to hazardous noise levels. It was argued that 3M was aware of the defects but failed to disclose the information to the military. The case gained attention when it was revealed that 3M agreed to pay $9.1 million in a settlement with the Department of Justice in 2018 to resolve allegations that the company knowingly sold defective earplugs to the U.S. military. The settlement did not provide compensation to individual service members but instead addressed allegations of fraud against the government. Subsequently, many individual lawsuits were filed by veterans and active-duty service members who claimed to have suffered hearing loss, tinnitus, and other hearing-related injuries as a result of using the faulty earplugs. These lawsuits sought compensation from 3M for medical expenses, pain and suffering, and other damages. The litigation process for the 3M Hearing Loss (Military Service) case involved consolidating many individual claims into multidistrict litigation (MDL). MDL allows similar cases from different jurisdictions to be centralized under one federal court to streamline the legal proceedings. The consolidated lawsuits were handled by a federal court in Florida. Settlement negotiations took place, and in July 2021, 3M reached a proposed settlement agreement of $285 million to resolve the claims. If the settlement is approved, eligible veterans and active-duty military personnel who used the defective earplugs may be eligible for compensation. It is important to note that while the case involved allegations of defective earplugs and their potential role in causing hearing loss, the litigation process and settlements have focused on the legal claims against 3M rather than determining individual cases of injury or establishing causation between the earplugs and specific hearing losses. https://www.oav4trk.com/KCFGJB7/2TP63BD/ submitted by

2023.06.07 12:49 thelynchmob1 This guy is making over $1m a year with porta-potty rentals
Here's a great story about an entrepreneur crushing it an unglamorous, unsexy industry:
porta-potty rental. Pooping is a great equalizer. No matter who you are — you, me, the King of England, the President of the United States, and the person who does the President’s dry cleaning — at some point in the last day or two, we’ve all had to sit down and perform this most basic of bodily functions.
(If you haven’t, please see a doctor urgently, or at the very least, eat more fibre.)
And when people have been doing something for thousands of years — eating out, building homes, swimming, watching plays, and yes, pooping — there’s probably a profitable business in that niche.
That brings us to
Gary Mead, the poop millionaire of Chelmsford, Essex, here in the UK. Gary has built Euroloo, his porta-potty rental business, into a company with revenue of about £9m and profit of £1m.
Renting porta-potties. How has he built this business?
Origins Gary’s story begins in the late 90s. At the tender age of 22, he started a small property management company in his home town of Chelmsford, Essex, about 30 miles northeast of London. According to his LinkedIn profile, he grew it every year for five years in a row, achieved profitability, and sold it. A successful exit by the age of 27 — not bad at all.
Possibly just to prove it wasn’t luck, Gary then started a small property management company in his home town of Chelmsford, Essex. He grew it every year for three years in a row, achieved profitability, and sold it. Again.
(If you take nothing else from this post, learn this: if Gary Mead ever sells you a property management company, make sure you include a non-compete clause.)
As a result, at just 30 years old, Gary had two successful exits under his belt. Likely holding some capital and a well-earned degree from the University of Hard Knocks, Gary scouted around for the next chapter in his career.
What next for this intrepid entrepreneur? Go for the property management three-peat? Start a SaaS business? Rest on his laurels and start a coaching business?
Not for young Gary. No,
Gary saw his future paved with brown gold. In 2003, Gary Mead founded Euroloo. Euroloo rents porta-potties to you, for a fee, including drop-off, pick-up, and weekly servicing.
This is what Mike Rowe would call a Dirty Job. When these porta-potties are dropped off on site on day one, they’re clean. When they’re picked up again on day seven, they are not. Someone has to make them clean again before renting them to the next customer.
That’s both a blessing and a curse. It’s a curse because, you know, you have to clean up poop. For more detail on this subject, check out this article from the wonderfully named company Poles and Holes:
“A good pair of gloves and a spray bottle full of cleaner is all it really takes to keep a porta-potties looking like new!”
It’s a blessing because grads from Harvard Business School and the LSE don’t want to go into this business. It’s not glamorous, it’s not sexy, and you probably don’t get admiring looks when you talk about it at the dinner table.
That’s great, because you don’t want to be competing against HBS and LSE grads. You want to compete, as Nick Huber says, with the type of person making a lot of money and using a fax machine. You are more likely to find those people in an industry like porta-potties. And with some smart use of technology, you can out-compete them.
SEO works with poop too Euroloo are doing a couple of things you don’t usually see from companies in industries like this.
Firstly, they’re putting time and money into paid search. If you google “portaloo hire [city]” you’ll see them come up (at least in the UK). I did this for my city, Nottingham, and Euroloo are #2 in the sponsored search results, and they’re also #2 in the organic search results.
If I click through on mobile, I’m taken to a landing page, that includes the city name, and a phone number with a local area code.
But wait! If I google “portaloo hire Manchester,” they’re the #2 sponsored result again. If I click through, I’m taken to a different landing page, that mentions a different city, with a different local phone number, which makes them look like a local Manchester business.
This is a level of tech and internet marketing that you honestly just don't see it blue collar industries like this. Definitely makes them stand out. And it's not
that hard to do either.
Is there money in porta-potties? Short answer: yes.
Euroloo are based in the UK so a lot of their company financials are public info. I dove into Euroloo’s financial statements to see what I could learn.
They don't publish a full P&L because they're so small, but their retained earnings -- i.e. the total cumulative profit in the business -- went up by £871k in 2022.
That means that after
any dividends paid, Euroloo made £871k profit. The UK corporate tax rate is 19%, and £871k is the after-tax profit, meaning the pre-tax profit must be £1.075m.
I also estimated their revenue based on the accounts receivable. Euroloo are selling to trade customers, probably on credit terms, so those construction crews and event management teams are paying for their porta-potties after they’ve used them.
On 31st March 2022 they had £422.8k outstanding in accounts receivable. That includes 20% VAT (UK sales tax) that they can’t count as revenue, so if we strip that out, we're left with a figure of £352k.
Guessing that their customers are on 14 day credit terms, then you do 352k / 14 * 365
=
£9.2m annualised revenue. Lastly, just for fun, I got a quote from Euroloo to rent my own porta-pooty.
The minimum rental period is 4 weeks at £195. That works out as £48.75 per week.
If their revenue is around £9.2m and each toilet rents for an average of £48.75 per week, we come up with a total of
188,438 toilet hire weeks per year. I'm guessing each toilet is in use 90% of the time to account for time spent picking up, cleaning, and delivering. That means they need about
4000 porta-potties. Their financials say they've spent £3.2m on fixed assets, which means
each toilet costs around £800 each.
This also tells us that the real business here isn’t buying expensive assets and renting them out. Porta-potties are about £800 each, and you can rent them for £48.75 a week.
Your payback period is less than 6 months. So this is really a logistics and distribution business. The trick here is making sure that your 4,000 porta-potties are on site, earning income, as much as possible.
The secret sauce So our master of poop, Gary Mead, has a business with around £9m in revenue, a fleet of around 4,000 portaloos, netting him at least £900k a year, while employing 93 people in the process.
What I really love is how Gary describes the secret sauce. The engine of growth. It’s word of mouth and repeat business. How do they drive that word of mouth? What ensures their incredible reputation?
Gary's LinkedIn page simply says:
We want our customers to recommend us to others and to use our services time after time because: - It’s easy to work with euroloo
- We deliver and service as promised
- We are friendly and customer focussed
- Our people are trained and good at their job
I love the simplicity. These principles are not rocket science. Euroloo is a phenomenal example of, as Charlie Munger says, “taking a simple idea, and taking it seriously.”
So you can get rich following
the Euroloo playbook:
- Pick an unglamorous industry.
- Focus on operational and customer excellence.
- Layer in some technology.
- Keep at it for 20 years.
That’s what Gary Mead has been doing since 2003. Over that time he's built an incredible business worth millions that provides a great living for him, his family, and his team. I love to see it. Anyone could do this. It’s not easy, but it is simple.
(if you want more detail, check out
this post, which includes a bunch of figures and screenshots I couldn't put here)
